Neglecting the issue of my mobile bought online

I have bought a smartphone from online site named FLIPKART.The product has an fault.According to flipkart policy One can replace it within 10 days.I was told by their customer executive to courier the product at the address given by them.From courier team i was informed that ther refuse to accept the delievery.Again asking to flipkart's customer executive they told we did any information and told me to wait tilll 8th of october.if they did not replace it,can i file a complain in consumer court.
